Acceptance of Terms

By accessing and using the Walk As If website (the “Site”), you agree to comply with and be bound by these Terms of Use (“Terms”). If you do not agree with any part of these Terms, you must not use the Site. These Terms apply to all visitors, users, and others who access or use the Site.

Organization Overview

Walk As If leverages immersive learning technology, specifically virtual reality, to educate and train soft skills to underserved populations. Our website educates users about the power and effectiveness of virtual reality in training individuals and promotes the importance of soft skills such as resilience, emotional intelligence, de-escalation, conflict avoidance, and financial literacy. Additionally, the Site provides information about our in-person education and lecture offerings, including workshops focused on soft skills.

Website Functionality

The Site offers various features, including but not limited to:

  • Donation processing
  • Event registration
  • Newsletters and email communications
  • Forums and community discussions
  • Blog posts and educational resources
  • Access to immersive virtual environments and training simulations

Users may interact with the Site by submitting forms, commenting, accessing resources, reading and downloading blogs and white papers, donating money, signing up for mailing lists, and participating in discussions and forums.

Expected User Behavior

Users are expected to engage in respectful communication. Prohibited activities include, but are not limited to:

  • Spamming or soliciting unauthorized donations
  • Discrimination, harassment, or hateful speech
  • Posting false or misleading information
  • Uploading or transmitting harmful or malicious content, including viruses or malware
  • Attempting to gain unauthorized access to the Site or its systems

User Age Restrictions

There are no age restrictions for users accessing the Site, but users under the age of 18 should have parental or guardian consent to use the Site.

User Rights

Users have the following rights regarding their personal data:

  • Access: Users may request access to their personal data that Walk As If holds.
  • Correction: Users can request correction of any inaccurate personal data.
  • Deletion: Users may request deletion of their personal data, subject to legal obligations.
  • Data Portability: Users have the right to request a copy of their personal data in a structured, commonly used, and machine-readable format.
  • Withdrawal of Consent: Users may withdraw their consent for the processing of their personal data at any time where Walk As If relies on consent as the legal basis for processing.

Content Ownership

Intellectual Property

All content on the Site, including text, blogs, technology platforms, immersive environments created using C# code language, trademarks, images, videos, and any other materials, is owned by Walk As If or its licensors. Unauthorized use of any content may violate copyright, trademark, and other laws.

User-Generated Content

Users are permitted to submit comments, photos, and videos. By submitting such content, users grant Walk As If the right to republish their comments, photos, and videos for marketing and promotional purposes. Walk As If reserves the right to moderate, edit, or remove user-generated content that violates these Terms or is deemed inappropriate.

Liability and Dispute Resolution

Liability Limitations

Walk As If limits liability for:

  • Inaccuracies on the Site
  • External links to third-party websites
  • Technology failures, including server outages and data loss
  • Misuse of the Site or its content
  • Donation misdirection (via PayPal)
  • Indirect, incidental, or consequential damages arising from the use of the Site or reliance on any information provided

Dispute Resolution Process

In the event of a dispute, users must first seek resolution through mediation. If unresolved, the dispute will be subject to arbitration under the rules of the American Arbitration Association (AAA) in accordance with the laws of the State of Colorado. Users agree to submit any disputes to mediation within 30 days of the incident giving rise to the dispute. Each party shall bear its own costs in connection with the mediation and arbitration.

Privacy Considerations

Walk As If collects personal data, including but not limited to names, email addresses, donation information, and user-generated content. User data may be shared with technology providers and vendors for operational purposes, including name, IP address, identifying information, and passwords (only when necessary to access the technology platform). Modification of Terms

Walk As If may update these Terms from time to time. Users will be notified of changes by posting a notice on the Site. Continued use of the Site after any changes constitutes acceptance of the new Terms. It is the user’s responsibility to review these Terms periodically.

Legal Compliance

These Terms are governed by the laws of the State of Colorado. Walk As If complies with applicable federal tax laws under the Tax Code section 501(c)(3), privacy laws, data retention laws, and data privacy laws. Additionally, laws of New Zealand may apply to the technology build, as our technology partner operates in New Zealand.

By using the Walk As If website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
